A prosecutor alleged in court this week that D4vd, who is accused of killing teen Celeste Rivas Hernandez, had child sex abuse material on his phone.

Born David Anthony Burke, the 21-year-old singer has been charged with murder, continuous sexual abuse of a child under the age of 14 and unlawful mutilation of human remains. He has pleaded not guilty and is being held without bail ahead of his trial.

At a Thursday, April 23 procedural hearing, Burke appeared in court wearing an orange jumpsuit, intermittently nodding and bobbing his head as Judge Charlaine F. Olmedo addressed the court.

In the court, as discovery was being discussed, Deputy District Attorney Beth Silverman said the prosecution possesses roughly 40 terabytes of evidence, which the defense has requested access to. She also alleged that “a significant amount of child pornography” was found on Burke’s phone. When this was mentioned, he showed no visible reaction and stared straight ahead.

Thursday also marks one year to the date that prosecutors allege Burke killed the 14-year-old girl, whose dismembered remains were later found in the trunk of Burke’s impounded Tesla in the Hollywood Hills in September 2025.

Rivas’ autopsy findings were unsealed this week, showing she died from “multiple penetrating injuries caused by object(s)” according to a report obtained by PEOPLE on Wednesday, April 22. Her manner of death was ruled a homicide.

Los Angeles County District Attorney Nathan Hochman has claimed that at the time she was killed, Rivas was a “witness” to a separate investigation into the “lewd and lascivious sexual acts” allegedly committed by Burke while she was under the age of 14.

Hochman said Burke’s alleged motive was to stop Rivas — who had threatened that night to expose him and harm his music career — from following through. The girl was last seen at the suspect’s home.

The autopsy findings identified two penetrating wounds to the torso that likely caused her death— one on the right side of the abdomen that damaged the liver, and another on the upper left chest that passed between two ribs and fractured adjacent ribs.

Following Burke’s arrest on April 16, Rivas’ parents, Jesus Rivas and Mercedes Martinez, released a statement through their attorney, Patrick Steinfeld, thanking law enforcement and remembering their late daughter.

“Celeste was a beautiful, strong girl who loved to sing and dance,” the statement said, in part, per NBC 4 Los Angeles. “Every Friday night was movie night and we spent wonderful times together. We love her very much and she always told us that she loved us. We miss her deeply. All we want is justice for Celeste.”

The Los Angeles Times previously reported that the Riverside County Sheriff’s Office had listed Rivas as missing from Lake Elsinore, Calif., on at least three occasions in 2024. Residents told the outlet she had run away before.

Due to special circumstances in Burke’s case, the murder charge carries a maximum sentence of life without the possibility of parole or the death penalty. Hochman said his office had not decided whether to pursue the death penalty.

An evidence hearing is set for April 29, and Burke’s preliminary hearing is scheduled to begin on May 1. It is expected to last several days.
